These Terms & Conditions govern the use of the Sumeria Music website and the purchase of music production, arrangement, mixing, mastering, and related creative services provided by Akshay Saxena, professionally operating under the name Sumeria Music.
By accessing this website, submitting an enquiry, purchasing a service, or providing project materials to Sumeria Music, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, subject to any rights that cannot legally be excluded.
1. About Sumeria Music
Sumeria Music is the professional and artist name under which Akshay Saxena provides independent music production and related creative services.
Sumeria Music works primarily with independent artists, musicians, bands, creators, and other clients on a remote basis internationally.
In these Terms, “Sumeria Music,” “I,” “me,” and “my” refer to Akshay Saxena operating professionally under the name Sumeria Music.
“You” and “client” refer to the person or entity purchasing or requesting services.
2. Services
Services may include music production, arrangement, mixing, mastering, and other creative services specifically described on the Sumeria Music website or agreed with the client.
The exact scope of each service is determined by the service description presented at the time of purchase and any specific written agreement or confirmation provided to the client.
Work outside the agreed scope may require an additional fee.
3. Enquiries and Project Approval
Submitting an enquiry, demo, reference, or project brief does not automatically create an obligation for Sumeria Music to accept the project.
I reserve the right to decline a project before payment for reasonable creative, technical, scheduling, business, or legal reasons.
A project is considered confirmed once the applicable service has been purchased and payment has been successfully received, unless otherwise agreed in writing.
4. Payments
Prices displayed on the website are stated in the currency shown at the time of purchase.
Payments are processed through the payment provider presented at checkout. I do not directly receive or store the client's complete payment-card information.
Production work will generally begin only after the applicable payment has been successfully completed and the required project materials have been received.
Where multiple services are purchased together, each purchased service forms part of the agreed project scope.
5. Client Materials and Rights
The client is responsible for providing all necessary project materials, including audio files, stems, demos, references, lyrics, instrumental files, notes, and other information required to perform the service.
The client confirms that they have the necessary rights, permissions, licences, and authority to provide those materials for the requested work.
The client must not knowingly submit material that infringes another person's copyright, trademark, privacy, publicity rights, or other legal rights.
I may refuse to process material that appears to involve unlawful activity, infringement, fraud, abuse, or other material that I reasonably consider unsuitable for the requested service.
6. Project Submission
After purchasing a service, clients may be directed to the Sumeria Music Project Submission page to provide project files, links, references, and production instructions.
Clients are responsible for ensuring that submitted file-sharing links are accessible and contain the correct files.
I am not responsible for delays caused by broken links, inaccessible files, incorrect files, missing information, unsupported formats, or incomplete submissions.
Clients should retain their own backups of all submitted materials.
7. Production Schedule and Turnaround
Estimated turnaround times may vary depending on the service, project complexity, number of revisions, client responsiveness, and current production schedule.
Any turnaround period communicated by Sumeria Music is an estimate unless a specific deadline has been expressly agreed in writing.
I am not responsible for delays caused by circumstances outside my reasonable control, including delayed client responses, missing materials, technical failures, third-party services, force majeure events, or substantial changes to the agreed project scope.
Where client delays materially affect a project schedule, the delivery date may be adjusted accordingly.
8. Revisions
Where revisions are included with a purchased service, they are intended to address reasonable changes within the original agreed creative and technical scope.
A revision does not mean a complete recreation of the project or a change to the original brief.
Requests that substantially change the original brief, require new production work, introduce additional songs or stems, or otherwise fall outside the agreed scope may be treated as additional work and may incur additional charges.
Clients should provide revision feedback as clearly and collectively as reasonably possible.
9. Client-Requested Changes and Additional Work
If a client requests work outside the purchased service or agreed scope, I may provide a separate quotation before carrying out that work.
Additional work will not be considered included merely because it relates to the same song or project.
I may pause additional work until the applicable additional payment has been received.
10. Delivery
Completed work will normally be delivered digitally using the delivery method agreed or provided by Sumeria Music.
The client is responsible for downloading and safely storing delivered files.
Unless otherwise agreed, I am not required to maintain permanent archives of completed project files.
Clients should maintain their own backups of all final files and materials.
11. Ownership and Usage Rights
Unless otherwise agreed in writing, the client retains ownership of original materials supplied by the client.
Upon full payment for the applicable service, the client receives the agreed rights to use the completed deliverables for their intended musical and commercial purposes, subject to any third-party rights or licences that may apply.
I do not transfer ownership of third-party software, samples, plugins, loops, recordings, or other third-party materials that may have been used in the production process.
Where third-party materials are subject to separate licence terms, the client remains responsible for complying with those terms.
Any ownership, royalty, publishing, master-rights, songwriting, or composition arrangements that differ from the standard service arrangement must be agreed in writing.
12. Credits and Portfolio Use
Unless otherwise agreed in writing, Sumeria Music may identify completed work as part of its professional portfolio and may display or reference the project, song title, artist name, artwork, or reasonable excerpts of completed work for promotional purposes.
If a client requires a project to remain confidential or does not want the work used publicly in the Sumeria Music portfolio, this should be communicated in writing before or during the project.
I will respect reasonable confidentiality requests agreed in writing.
13. Confidentiality
I will treat unreleased project materials and confidential project information responsibly and will not intentionally disclose confidential client materials to unrelated third parties except where necessary to provide the service, comply with law, protect legal rights, or operate required technical and payment services.
The client is likewise responsible for maintaining the confidentiality of any proprietary information provided by Sumeria Music.
14. Refunds and Cancellations
Because Sumeria Music provides customised creative services that may involve work beginning specifically for an individual client, cancellation and refund eligibility may depend on whether production work has started and the applicable law.
A client should contact me as soon as possible if they wish to cancel a purchase.
Where production has not started, I may, subject to applicable law and the circumstances of the purchase, consider a cancellation or refund request.
Once substantial customised work has commenced, refunds may be limited to the extent permitted by applicable law.
Nothing in these Terms is intended to remove or restrict any mandatory consumer rights that cannot legally be excluded.
Any approved refund will normally be processed through the original payment method where practicable.
15. Chargebacks and Payment Disputes
Clients agree to contact me first regarding genuine payment, service, or delivery concerns and to provide a reasonable opportunity to resolve the issue before initiating a payment dispute or chargeback, where permitted by applicable law and payment-provider rules.
This does not prevent a client from exercising any legal rights available to them.
I reserve the right to provide relevant transaction records, communications, project information, delivery records, and other appropriate evidence to a payment provider or financial institution in response to a disputed transaction.
16. Service Refusal and Termination
I may refuse, suspend, or terminate a project where reasonably necessary, including where:
the client provides unlawful or infringing material;
the client engages in abusive, threatening, discriminatory, fraudulent, or harassing conduct;
required payment has not been received;
the client repeatedly requests work outside the agreed scope without agreement;
the project requires conduct that would violate applicable law or third-party rights; or
continuing the project would create an unreasonable technical, legal, or business risk.
Where termination occurs, any refund or payment consequences will be determined according to the circumstances and applicable law.
17. No Guarantee of Creative or Commercial Results
Music production is a creative service and involves artistic judgment.
I will perform services professionally and in accordance with the agreed brief and scope, but I cannot guarantee a particular commercial result, number of streams, chart position, audience response, revenue level, playlist placement, record-label interest, or other outcome.
18. Third-Party Services
Sumeria Music may rely on third-party services such as payment processors, file-sharing platforms, website providers, hosting providers, communication services, or other technical providers.
I am not responsible for outages, failures, policy changes, security incidents, or other circumstances caused directly by third-party services outside my reasonable control.
19. Website Content
The content of this website is provided for general informational and promotional purposes.
I may update, modify, remove, or replace website content, service descriptions, pricing, availability, portfolio material, and other information at any time.
Website content does not create a contractual commitment unless expressly incorporated into an agreed purchase or written service arrangement.
20. Intellectual Property in the Website
Unless otherwise stated, the Sumeria Music website, branding, artist name, logos, original text, graphics, photographs, design elements, and other original website content are owned by or licensed to Akshay Saxena and may not be copied, reproduced, republished, or commercially exploited without permission.
Client-owned music, artwork, trademarks, and other materials remain the property of their respective owners.
21. Limitation of Liability
To the maximum extent permitted by applicable law, I will not be liable for indirect, incidental, consequential, special, or unforeseeable losses arising from the use of the website or provision of services.
My liability in relation to a particular paid service will, to the extent permitted by applicable law, be limited to the amount actually paid by the client for the specific service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
22. Client Responsibility
The client is responsible for reviewing supplied files, approvals, final mixes, masters, metadata, credits, and other deliverables before commercial release or distribution.
The client remains responsible for ensuring that their release complies with applicable copyright, licensing, publishing, distribution, platform, tax, and other legal requirements.
23. Force Majeure
I will not be responsible for failure or delay caused by circumstances beyond reasonable control, including serious technical failures, internet or infrastructure outages, natural disasters, governmental actions, war, civil unrest, widespread service outages, illness, or other events that could not reasonably have been prevented.
Where possible, I will communicate significant delays and work to resume the project as soon as reasonably practicable.
24. Privacy
Personal information submitted through the website or during a project is handled in accordance with the Sumeria Music Privacy Policy.
Information may need to be processed by me and relevant service providers for purposes including enquiries, payment processing, project delivery, communication, administration, security, and legal compliance.

25. Changes to These Terms
I may update these Terms from time to time to reflect changes to services, business practices, technology, or applicable legal requirements.
The version published on the website will apply to future website use and purchases from its effective date.
Where a change materially affects an existing confirmed project, the Terms applicable to that project will be considered together with any specific agreement already made with the client.
26. Governing Law and Disputes
These Terms are intended to be governed by the laws applicable to Akshay Saxena and the operation of Sumeria Music, subject to any mandatory consumer protections that apply to a client in their jurisdiction.
Before commencing formal proceedings, both parties should make a reasonable attempt to resolve a dispute directly and in good faith.
Nothing in this section is intended to prevent a consumer from exercising mandatory rights available under the laws that apply to them.
